These Terms of Service ("Terms") govern your use of services provided by Dilmun Digital ("we," "us," "our"), based in Manama, Bahrain. By engaging our Services, you agree to these Terms.

1. Description of Services

Dilmun Digital provides AI-powered automation, voice agent, and website/CRM setup services for businesses, including but not limited to:

Custom website design and development

AI voice agent setup and configuration

CRM and marketing automation (via platforms such as GoHighLevel)

Related consulting and technical support

2. Eligibility

Our Services are intended for business use only (B2B). By using our Services, you confirm that:

You are at least 18 years old

You have the authority to enter into this agreement on behalf of your business

You are using our Services for legitimate business purposes

3. Payment Terms

Services are billed via a one-time setup fee and, where applicable, an ongoing monthly retainer for management, hosting, or continued automation services.

Payment terms, amounts, and due dates will be confirmed in an individual proposal or invoice prior to work beginning. Refunds & Cancellation:

If you cancel before any work has begun, your setup fee will be fully refunded.

Once work has commenced, the setup fee is non-refundable, as it reflects custom labor and configuration already performed.

Monthly retainer services may be cancelled at any time with 30 days' written notice. No refund will be issued for the current billing period already in progress at the time of cancellation.

4. Client Responsibilities

You agree to:

Provide accurate information needed to set up and operate your AI systems (e.g. business details, scripts, scheduling info)

Use our Services lawfully and not for fraudulent, harmful, or abusive purposes

Respect our intellectual property and not resell, copy, or reverse-engineer our systems without written permission

Ensure any data you provide us (e.g. customer contact lists) was collected lawfully and that you have the right to share it with us

5. Our Rights

We reserve the right to:

Suspend or terminate Services for non-payment, misuse, or violation of these Terms

Modify or discontinue features of our Services with reasonable notice

Decline to provide Services to any business at our discretion

6. Intellectual Property

Our Content: Templates, workflows, scripts, and systems we build using our own proprietary methods remain our intellectual property unless otherwise agreed in writing.

Client Content: Any content, branding, or data you provide remains your property.

AI Outputs: Outputs generated by AI systems we configure (e.g. chat responses, booking confirmations) are provided for your business use. We do not guarantee the accuracy of AI-generated responses in every scenario and recommend periodic human review of AI interactions.

7. Limitation of Liability

To the fullest extent permitted by law:

We are not liable for indirect, incidental, or consequential damages arising from use of our Services, including lost profits or lost business opportunities.

AI systems may occasionally produce inaccurate, delayed, or unexpected responses. We are not liable for outcomes resulting from AI errors, provided we have made reasonable efforts to configure the system accurately based on information you provided.

Our total liability for any claim related to our Services is limited to the amount you paid us in the three (3) months preceding the claim.

8. Disclaimers

Services are provided "as is" and "as available." We do not guarantee specific business outcomes (e.g. exact revenue increases, lead conversion rates) as results depend on factors outside our control

9. Termination

Either party may terminate ongoing Services with written notice as specified in your service agreement. Upon termination, outstanding fees for work completed remain due.

10. Governing Law & Disputes

These Terms are governed by the laws of Bahrain. Any disputes arising from these Terms will first be addressed through good-faith negotiation between the parties before pursuing formal legal action.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of our Services after changes are posted constitutes acceptance of the updated Terms.
